Terms of Service

These Terms govern your access to and use of Fly Overhead websites, applications, and services. By creating an account, subscribing, or using the Service, you agree to these Terms.

1. Eligibility and accounts

You must be at least 13 years old to use Fly Overhead. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

2. Aviation use is advisory only

Fly Overhead provides flight tracking, planning, weather, charting, and electronic flight bag tools for situational awareness and planning only. It is not a substitute for FAA-approved navigation, current official charts, certified weather products, NOTAM sources, aircraft instruments, or pilot judgment.

The pilot in command retains sole authority and responsibility for every operational decision. Always verify safety-of-flight information against official sources before using it in flight planning or in flight.

3. Data sources and availability

Aircraft positions, airport information, charts, weather, NOTAMs, procedures, airspace, terrain, and route data are derived from third-party sources and may be delayed, incomplete, inaccurate, unavailable, or out of date. ADS-B and internet coverage gaps are common.

4. AI features

AI-generated briefings, route insights, debriefs, summaries, and other outputs may be incorrect, incomplete, or misleading. You are responsible for independently verifying AI output before any operational use.

5. Subscriptions and billing

Paid plans, prices, feature scope, renewal terms, and cancellation options are shown at checkout and in account settings. Subscription payments are processed by Stripe. Unless otherwise stated, subscriptions renew automatically until cancelled, and cancellation takes effect at the end of the current billing period.

6. Acceptable use

You may not use the Service to violate law, compromise safety, harass or surveil others without authorization, bypass access controls, scrape or redistribute data outside permitted API terms, interfere with the Service, or develop a competing product using non-public Service data.

7. User content

You retain ownership of content you submit, such as saved routes, notes, aircraft profiles, checklist data, logbook entries, and debrief material. You grant Fly Overhead the limited rights needed to host, process, and display that content as part of operating the Service.

8. No warranties

The Service is provided as is and as available, without warranties of any kind. We do not guarantee uninterrupted availability, data accuracy, or fitness for any particular flight, aircraft, route, or operational use.

9. Privacy

Our Privacy Policy explains how we collect, use, and share information. Our Feeder Data Policy explains how ADS-B feeder data is handled.
